These Terms & Conditions apply to every order placed and every use of www.mnare.com (the "Site"), operated by Mnaré, registered in the Netherlands under Chamber of Commerce (KVK) number 42080938, located at Koningin Julianaplein 16, 2273 BR Voorburg (postal address only, not open to visitors) ("Mnaré," "we," "us," "our").
By placing an order or using the Site, you ("customer," "you") agree to these Terms & Conditions. We may deviate from these terms only if agreed in writing.
1. Prices
1.1 All prices shown on the Site are in euros and include VAT, unless stated otherwise.
1.2 Shipping costs are not included in the product price and will be shown separately at checkout before you complete your order.
1.3 We reserve the right to change prices at any time. Price changes do not affect orders already confirmed.
2. Orders and Formation of Contract
2.1 A contract is formed once we have confirmed your order by email.
2.2 We reserve the right to refuse or cancel an order, for example in case of an evident error in price or product description, or in case of suspected fraud.
3. Payment
3.1 Payment is made at checkout using one of the available payment methods.
3.2 Your order will only be shipped once payment has been received in full.
4. Shipping and Delivery
4.1 Delivery takes place while stock lasts.
4.2 Delivery times stated on the Site are indicative. Exceeding a stated delivery time does not entitle you to compensation or to dissolve the contract, unless otherwise agreed in writing, or unless we fail to deliver within 14 days after receiving written notice of default from you.
4.3 The delivery period starts once you have completed the order process and received an order confirmation from us.
4.4 Shipping costs are charged separately at checkout and are calculated based on destination and order size. Shipping costs are non-refundable in case of a return, except where the return is due to our error.
4.5 Risk of loss or damage to products passes to you at the moment of delivery.
5. Right of Withdrawal (14-Day Cooling-Off Period)
5.1 As a consumer, you have the right to cancel your order within 14 days of receiving your product(s), without giving a reason.
5.2 You can exercise your right of withdrawal directly through the digital cancellation function on our Site, or by following the return instructions provided there. Each order must be returned separately.
5.3 To be eligible for a full refund, returned products must be:
- unworn, unwashed, and undamaged;
- in their original condition with all original tags attached;
- returned in their original packaging where reasonably possible.
5.4 If a returned product shows signs of wear, stains, odors, or other use beyond what is necessary to assess the product, we reserve the right to apply a value deduction to the refunded amount, proportional to the loss in value. We will inform you of this in advance with a clear explanation.
5.5 Products damaged due to misuse are not eligible for return or refund.
5.6 The following products are excluded from the right of withdrawal:
- products made or customized specifically for you;
- gift cards;
- products that cannot be returned for hygiene reasons (such as accessories worn close to the skin), if the hygiene seal has been broken.
5.7 The 14-day period starts on the day after you (or a third party designated by you) receive the product. You must return the product within 14 days after notifying us of your wish to withdraw.
5.8 Return shipping costs are at your own expense, unless the return is due to an error on our part.
5.9 We will refund the amount due within 14 days after receiving the returned product, or after you have provided proof of return shipment, using the same payment method you used for the original order.
6. Warranty
6.1 We warrant that products correspond to their description on the Site at the time of delivery.
6.2 This warranty does not cover defects caused by normal wear and tear, improper use, or failure to follow care instructions.
6.3 Please inspect your order as soon as possible after receipt and contact us promptly if you discover any defects.
7. Retention of Title
Ownership of delivered products remains with Mnaré until full payment has been received.
8. Liability
8.1 Mnaré is only liable for damage that is the direct result of intent or gross negligence on our part.
8.2 We are never liable for indirect damage, including but not limited to lost profits or consequential losses.
8.3 Nothing in these Terms & Conditions limits liability that cannot be excluded under applicable law, including liability for death or personal injury caused by our negligence.
8.4 Images, colors, and descriptions on the Site are indicative. Minor variations between the website and the actual product (for example due to screen display) do not constitute a defect.
9. Force Majeure
9.1 We are not liable for any failure or delay in performing our obligations if this is caused by circumstances beyond our reasonable control, including but not limited to natural disasters, strikes, transport disruptions, supplier failures, or technical failures.
9.2 If a force majeure event lasts longer than 30 days, either party may cancel the affected order in writing.
10. Complaints
10.1 If you have a complaint about a product or our service, please contact us as soon as possible, and in any case within 7 days of discovering the issue, at info@mnare.com.
10.2 We will respond to your complaint within a reasonable timeframe and aim to resolve it fairly.
11. Intellectual Property
All content on the Site, including text, images, logos, and designs, is owned by Mnaré or our licensors and may not be copied, reproduced, or used without our prior written consent, except for personal, non-commercial use.
12. Links to Third-Party Websites
The Site may contain links to third-party websites. We have no control over these websites and are not responsible for their content or practices.
13. Changes to These Terms
We may update these Terms & Conditions from time to time. Material changes will be communicated where reasonably possible. The version applicable to your order is the version published on the Site at the time you placed your order.
14. Governing Law and Jurisdiction
14.1 These Terms & Conditions are governed exclusively by the laws of the Netherlands.
14.2 Any disputes will be submitted to the competent court in the Netherlands, unless mandatory law provides otherwise.
